This program will give an overview of the Child Victims Act (CVA) and Adult Survivors Act (ASA), why they were passed, the elements of each, the total number of cases filed in New York, the most common defendants, and the issues that can arise while prosecuting or defending such claims. Participants will understand the unique intricacies of the CVA and ASA, the most common cases brought, and how to manage clients and defendants through the resolution of these matters. The program also includes a discussion on Insurance Archeology, the practice of locating historic insurance coverage which covers historic sexual abuse/misconduct claims as well as other longtail liabilities.
